These Terms & Conditions (“Terms”) govern your use of the website https://bradthontlinphotography.com (the “Site”) and your purchase or booking of photography services from Brad Thontlin Photography (“Company,” “we,” “our,” or “us”).
By using our Site or booking a session, you agree to these Terms.
1. Services
Brad Thontlin Photography provides professional photography services including family sessions, headshots, couples sessions, and related photo products. Details about services, pricing, and availability are described on the Site or provided directly to you when booking.
2. Booking and Payment
- Bookings are confirmed only after you complete our booking process through our third-party booking platform or by direct agreement with us.
- Payment terms (retainer requirements, remaining balance due dates) will be stated at the time of booking.
- All session fees are non-refundable.
3. Cancellation and Rescheduling
- No Refunds: All session fees are non-refundable. Your payment secures your date and time on our calendar.
- Rescheduling: You may request to reschedule your session by contacting us at least 48 hours in advance. Reschedules are subject to the photographer’s availability. If rescheduling is not possible, your payment will be applied as a credit for a future session within 6 months of your original booking date.
- Late Arrivals / No-Shows: Late arrivals may result in reduced session time as there may be a session immidiately after your session. Failure to attend your session without notice will result in forfeiture of your session fee.
4. Photo Delivery
- Final edited images will be delivered via an online gallery within 7 days after the session.
- Delivery times may vary during peak seasons and projects.
5. Image Use and Copyright
- Ownership: All images remain the copyright of Brad Thontlin Photography.
- Personal Use License: Clients are granted a personal, non-exclusive license to download, share, and print images for personal use only.
- Prohibited Uses: Images may not be sold, altered in a way that misrepresents the photographer’s work, used commercially, or submitted to contests without prior written permission.
6. Client Responsibilities
- You agree to arrive on time and cooperate during the session to achieve the best possible results.
- You are responsible for obtaining any necessary permissions or permits for locations that require them.
7. Limitation of Liability
- We will take reasonable care in capturing and delivering your images.
- In the rare event of equipment failure, accident, or other circumstances beyond our control that prevent delivery, our liability is limited to refunding any fees paid.
- We are not responsible for incidental damages, missed opportunities, or emotional distress arising from missed sessions or delays.
8. Privacy and Data Protection
Your personal information is handled according to our Privacy Policy and Cookie Policy.
9. Website Use
You agree not to use our Site for any unlawful purpose, attempt to hack or interfere with its functionality, or copy content without permission.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of our Site or services after updates means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
